Terms and Conditions taken from Dr Fertility's site.
1. About Us & General
Our mission at Dr Fertility is to support anyone on their fertility journey through providing fertility education, products, and services.
We are passionate about helping people and, ‘doing what is right’ for the user is at the heart of everything we do. We hold ourselves to the highest ethical and legal standards and we value hearing from you. If you have any questions or ideas on how we can improve the quality of the education, products and services we provide, please contact us.
Please read these terms carefully so that you understand them. These terms cover all the Products, Services and Content we provide to you through our Website.
Any reference to “Dr Fertility ”, “our”, “us”, “we” and “Company” are references to Dr Fertility Ltd, a limited company registered in England and Wales (company number 11403516), the registered office being Dr Fertility Ltd, Suite 501, Department Bonded Warehouse, 18 Lower Byrom Street, Manchester M3 4AP.
Except for our Healthcare Consultations, where we provide medical advice, all our other Services, including our content, customer care line 0330 330 3849 and our navigation call service provide general healthcare information and not medical advice, diagnosis and/or treatment. Our information services are not a substitute for a doctor or other healthcare professional. You should not take or stop taking any action (such as taking or not taking medicines) based on information from our information services. We make no warranties in relation to the output of our information services.
Definitions:
“Content” – we provide a range of content on our Website, including product and service descriptions, blogs, videos, and images.
“Clinicians” - our Healthcare Consultations are provided using appropriately qualified medical professionals such as doctors, nurses and pharmacists based in the UK
“Dropship Partners” – we fulfil some Products directly from manufacturers and distributors where necessary
“Fulfilment Partner” - we fulfil product orders for Products we stock via our partner Virtual Distribution Ltd
“Healthcare Consultations” – our Clinicians;
- provide telephone consultations and video consultations via our Third-Party Clinical System,
- where appropriate they may prescribe medicines during video Healthcare Consultations when photo ID has been provided and in line with our prescribing formulary: and
- make referrals when required to other healthcare providers to ensure continuity of care.
“Home Testing Services” – our range of testing services that can be undertaken at home.
“Products” – we offer a range of fertility products including fertility monitors, ovulation tests, pregnancy tests, fertility lubricants, vitamins and supplements
“Services” – these include Healthcare Consultations and the Home Testing Services.
“Testing Provider” - we work with Medichecks.com Ltd to offer Home Testing Services
“Third-Party Clinical System” – we utilise Heydoc Ltd software to provide video Healthcare Consultations
“Website” – we provide Products, Content and Services via our Website https://www.drfertility.co.uk
“Website Provider” – our website is managed and hosted by the third-party provider Shopify Inc.
We only provide our Products and Services to people 18 years old and over.
2. Our Healthcare Consultations

Please note that Dr Fertility is NOT to be used in an EMERGENCY situation
OUR SERVICES ARE NOT SUITABLE FOR ANY EMERGENCY SITUATION OR DIAGNOSIS OR TREATMENT THAT REQUIRES A PHYSICAL EXAMINATION.
IF YOU BELIEVE THAT YOU OR THE PERSON YOU ARE ASSISTING IS IN AN URGENT OR EMERGENCY SITUATION (OR YOU THINK THERE IS THE OPPORTUNITY FOR THIS SITUATION TO ESCALATE TO ONE CONSIDERED TO BE AN EMERGENCY SITUATION) OR YOU REQUIRE URGENT OR EMERGENCY TREATMENT YOU MUST IMMEDIATELY DIAL 999.
MEDICAL EMERGENCIES CAN INCLUDE (BUT THE FOLLOWING IS NOT AN EXHAUSTIVE LIST):
- Loss of consciousness
- An acute confused state
- Fits that are not stopping
- Persistent, severe chest pain
- Breathing difficulties
- Severe bleeding that cannot be stopped
- Severe allergic reactions
- Severe burns or scalds
- Pain and bleeding in early pregnancy
Call 999 immediately if think you or someone else is having a heart attack or stroke.
a) We provide our Healthcare Consultations using our Third-party Clinical System and by telephone. We use other communication methods such as email and SMS to provide other Services where appropriate.
b) You should always seek advice from a medical Clinician in person if you are unsure about whether you have been able to adequately explain or communicate your medical needs through our Healthcare Consultations, or if you have any concerns about the advice you receive from us or if it is different from other advice you have received.
c) If you use our Healthcare Consultations or content, we strongly encourage you to discuss any information you receive from us with your GP or usual medical Clinician.
d) Clinicians will be doctors registered with the General Medical Council, appropriately qualified nurses registered with the Nursing and Midwifery Council or pharmacists registered with the General Pharmaceutical Council.
e) If you do not attend pre-booked Healthcare Consultations, are more than 15 minutes late or cancel without 48 hours’ notice, you may be liable for cancellation charges (in an amount up to the price of the Healthcare Consultation, if we are unable to find an alternative to take the booking slot) and/or further costs to rebook your appointment.
3. What we need from you in order to provide our Healthcare Services
We can only provide Healthcare Consultations in accordance with these terms if you provide us with the information we need in order to help you. You must:
i. be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us;
ii. if you require a prescription following your Healthcare Consultation, be able to show the Clinician a valid form of photo ID;
iii. ensure that any information you give to us or a Clinician, or enter into the Website is accurate and in English;
iv. ensure that if you have any concerns about the information we provide to you or any information on our Website, you will seek further medical advice;
v. follow any instructions you are given by Clinicians;
vi. follow any instructions regarding the use of any medicines or Products we recommend or prescribe (including in respect of use-by dates);
vii. report any adverse or unexpected effects of medicines or Products to us;
viii. keep any medicines we give you securely and do not allow others (especially children) to use them;
ix. tell us if any of our information about you is or becomes inaccurate or incomplete; and
We rely on an accurate record of your use of Services in order to do this. Please do not therefore register more than once for our Services. If you have changed your name and/or contact details please contact us.
4. Medicines
a) In the United Kingdom, our prescribing Clinicians are permitted to prescribe medicines without meeting the patient face to face and can therefore prescribe through video consultations. Please note not all Clinicians can prescribe.
b) All Clinicians who have signed up to provide prescriptions through the Company’s systems have undertaken to comply with the General Medical Council, Nursing & Midwifery Council and General Pharmaceutical Council Guidelines on remote prescribing, essential standards of quality and safety as enforced by the Care Quality Commission.
c) Dr Fertility clinicians will only issue a prescription for medicines that are deemed clinically safe, appropriate for patients and are on Dr Fertility’s approved medicines formulary. We do not provide prescriptions for:
i. For patients, whose proof of ID has not been verified by the Dr Fertility Clinician
ii. Unlicensed medicines
iii. Medicines which, in the view of our in house clinicians and medical advisors, are unsuitable for remote prescribing i.e. those that may require physical examination before issuance or those that need to be issued under the supervision of a specialist
iv. Medicines that can be purchased over the counter (OTC) from a pharmacy
v. Medicines for the treatment of long-term conditions, other than those related to fertility
vi. Medicines that may be subject to abuse by users, for example:
- Controlled drugs
- Sedatives
- Strong pain killers
vii. Where licensed medicines are prescribed for an unlicensed indication this will be explained during the consultation and additional information will be made available to you to so that you can make an informed decision regarding your treatment
d) Prescriptions provided will be private prescriptions and you will need to pay your pharmacist for your medicine(s). The price of the medicine(s) is set by the pharmacy and is independent of any charges set by Dr Fertility. The patient is under no obligation to purchase their medicine from any particular pharmacy.
e) Where possible, we will send your prescription to a pharmacy of your choice for you to collect as soon as is reasonability possible. If your preferred pharmacy does not have the medicine in stock, we may need to send it to another pharmacy nearby.
5. Our Home Testing Services
a) Our Home Testing Services are offered via our Website and during Healthcare Consultations where appropriate. These services are provided in collaboration with the Testing Provider Medichecks.com Ltd with which Dr Fertility has entered into arrangements for those services.
b) By ordering any Home Testing Services, you agree to comply with any instructions provided in relation to the Home Testing Services, including in relation to the booking and administration, receipt and provision of test materials and/or samples. We do not accept responsibility for any results that are compromised due to you not complying with any instructions in relation to the provision of test materials and/or samples.
c) You can request the dispatch, by post, of a Home Testing Service to be administered (self-collected) by you and provided to the laboratory by post, with the results then analysed, sent to us and discussed between you and a Clinician.
d) You must send samples collected to the laboratory using the pre-paid envelope provided on the day the sample was taken to ensure that it arrives at the laboratory the following working day. The sample must arrive on a week day when the lab is open. Failure to do so may lead to deterioration of your sample, which could affect the accuracy of your test results. We do not accept responsibility for results that are compromised due to delays in returning samples or where samples are lost in the post. If you are concerned that your usual postal service will not result in next day delivery, we recommend that you return your sample using a guaranteed next-day service. This will be at your cost.
e) The prices for the Home Testing Services will be displayed on the Website and communicated by the Clinician during the Healthcare Consultation if required.
f) If for any reason, we are unable to perform the Home Testing Services, we will inform you by email or by phone. If you have already paid for the Home Testing Services, we will refund you the full amount within 3 working days.
g) By purchasing a test and sending a sample you acknowledge that our Testing Provider Medichecks.com Ltd and its partner laboratories will perform the tests you have ordered in order to provide healthcare and/or medical diagnosis.
h) Once your testing kit has been dispatched, you have up to 14 days to cancel the order. You must return the unused and unopened testing kit, if we have sent one to you, to Medichecks.com Limited, MediCity, Thane Road, Nottingham, NG90 6BH. If the testing kit you return is complete, unused and undamaged, we will give you a full refund within 14 days of us receiving it. If the returned kit is incomplete, used or damaged in any way, you may incur a cancellation charge of £5 to cover the cost of the testing kit. This charge will be deducted from the total amount refunded to you.
This cancellation right does not apply if:
- you have already had a sample taken at a clinic, laboratory or at home as arranged by us
- you have already sent your sample to the laboratory for analysis;
- or the 14-day cancellation period has expired.
i) Any sample you send (whether it is blood, tissue, bodily fluid, or other biological sample) for analysis will be analysed only in relation to the specific test or tests that you have ordered.
j) Occasionally our Testing Partner is unable to test samples sent to them. This may be because the amount collected is insufficient for full analysis, the sample has deteriorated or clotted or because it has haemolysed (where red blood cells damaged during sample collection leak their contents into the surrounding plasma). Testing failure most commonly occurs with blood samples taken using finger-prick home collection kits. If the laboratory cannot test your sample, we will send a second home collection kit to you free-of-charge for you to repeat the process. If this second sample cannot be tested, we will give you the option to cancel the order and request a full refund.
k) Every test has a corresponding turnaround time which is an estimate of the time it will take for your sample, once received by the laboratory, to be tested and the test results made available to you. It is an estimate only and is stated in working days. If you purchase multiple tests in one order we may, in certain circumstances, make results available to you only when the results of all tests have been received from the laboratory.
l) You cannot purchase the Home Testing Services anywhere outside the United Kingdom.
6. Our Products
a) By placing an order, you are offering to purchase a Product on, and subject to, the following terms and conditions. All orders are subject to availability and confirmation of the order price. We aim to dispatch orders the same day, when the order is placed before 3pm on a working day or the next working day if your order is placed after 3pm. Once your order has been dispatched we will email you a dispatch confirmation. A contract between us for the purchase of the Product will not be formed until we have sent your dispatch confirmation.
b) For some Products, orders are fulfilled via a Dropship Partner and not directly from our warehouse. These orders will be forwarded to the relevant Dropship Partner by the next working day. The time to dispatch orders via Dropship Partners can vary. Once we have received dispatch confirmation, we will communicate this to you via email.
c) Dispatch times may vary and representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible for.
d) When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card, PayPal or Amazon Pay account used to place your order and that there are sufficient funds to cover the cost of the Products. All prices advertised are subject to such changes. Whilst we try and ensure that all details, descriptions and prices which appear on our Website are accurate, errors may occur. If we discover an error in the price of any Products which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. Where applicable, prices are inclusive of VAT.
e) Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost’. Our Website may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fulfil any orders that you may place based on information on the Product related services that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.
f) If you would like to return your order, please contact us, return the Product unopened, in the condition in which it was sent and with the invoice within 14-days of you receiving the product and we'll refund the product price within 14 working days of receiving it. We will also refund an amount equal to the price of the cheapest postal method offered for the Products but if you chose a more expensive postal method we will not refund any excess. The additional postage cost of returning the product will be at your own cost.
g) In the unlikely event that you receive the wrong Product(s) or your Product(s) are faulty, please contact us and we will arrange to either repost your order, replace the Product(s) or refund your order based on the issue.
7. Payment
a) You may pay for Products and Services using a debit or credit card and this includes MasterCard, Visa, Visa Electron, Switch, Solo, Maestro or JCB. We also accept payment for Products via PayPal and Amazon Pay.
b) Payment must be received in full in cleared funds prior to us processing your order or booking. No Products will be dispatched or Services commenced until payment in full cleared funds is received and we shall not be liable to you for any loss you suffer as a result of such delays.
8. Our liability to you
a) If we break any of these terms and you suffer loss or damage, we are responsible for compensating you for that loss or damage if it was a foreseeable result of breaking these terms.
b) We are not responsible for compensating you for loss or damage that is not a foreseeable result of breaking these terms. Nor will we be liable for indirect, incidental, special or consequential damages.
c) We are not responsible for any business related losses or losses to non-consumers.
d) Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation or for any other liability which cannot be excluded or limited under applicable law. Nothing in these Terms shall affect your statutory rights.
e) Subject to the extent permitted by law, neither Dr Fertility, our Clinicians or any third parties involved in or connected with the provision of the Services or the Products shall be liable for:
i. any loss or damage relating to the supply of the Products that is greater than the price of the Product;
ii. any emotional distress or disturbance that arises from use of the Products or the Services to the extent that this arises other than where there has been personal injury caused by our negligence;
iii. any loss, damage or distress to the extent that it is caused or contributed to by you failing to provide appropriate, timely, accurate and full information in respect of the Healthcare Consultations;
iv. any loss, damage or distress arising from your improper use of the Products or not following the Home Testing Services in accordance with their instructions.
f) Subject to the extent permitted by law, neither Dr Fertility, Clinician or any third parties involved in or connected with the provision of the Products and Services shall be liable for any loss, damage or distress or damages arising in circumstances where the Products and Services are used for any treatment that is urgent, is an emergency or where a physical face to face examination is required or where the issue is suited to non-remote communication. We advise that, in any of these circumstances, you contact your GP, other medical Clinician or the emergency services.
g) We design our Services and Website to keep your personal data and health and medical information secure and it is important that you follow the usage instructions and security advice in these terms in order to keep your data safe (including, but not limited to, never sharing passwords, logging out of public computers, using unique passwords that are regularly changed). We are not liable for loss or unauthorised access to your data where it results from you not following these instructions and advice.
h) The Content of Dr Fertility is provided for general information only. We do not warrant that information we provide in the Content will meet your health or medical requirements. In particular, the Content is not a substitute for professional medical care by a qualified doctor or other healthcare professional. If you are not a healthcare professional then you should always check with your doctor if you have any concerns before taking, or refraining from, any action on the basis of the Content of Dr Fertility. If you are a healthcare professional then this information (including any professional reference material) is intended to support, not replace, your own knowledge, experience and judgement.
i) We go to great efforts to ensure that the information on each Product page is accurate at the time that the page was last edited, however, you should always check Product labelling, warnings, and directions provided with the Product that is delivered, prior to use or consumption. You must consult your doctor before taking any vitamin or supplement if you suffer from an underlying medical condition, have a known fertility problem or if you are taking any other medication, supplements, or complementary therapy.
j) This Website also contains links to other websites, which are not operated by Dr Fertility (the "Linked Sites"). Dr Fertility has no control over the Linked Sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them. Your use of the Linked Sites will be subject to the terms of use and service contained within each such site.
9. Limitations of our service provision
a) All Services are currently only provided in English, however we will be expanding the languages we can provide.
b) We are unable to provide physical or in person examinations or any form of assisted reproductive technology (for example, IVF and similar treatments). Please also be aware that not all Clinicians can provide prescriptions.
c) We may not be able to provide our Services if they are affected by events outside our control. We are not responsible to you if this happens, but if it does, we will notify you as soon as we can and take the steps that we reasonably can to minimise the interruption to our Services.
10. Technical requirements
a) Our Services are accessed remotely using the internet, data networks and devices which can access the internet (“Infrastructure”) and operate the Website. We make our Website available for access using Infrastructure but are not responsible for Infrastructure ourselves. If you wish to use the Services, you should ensure you have an internet-enabled device and a sufficient internet connection available.
b) When you use the Website or send emails to us, you are communicating with us electronically. We will communicate with you using methods such as email, SMS, live chat, video consultation or via the telephone where necessary.
c) We operate anti-virus and malicious software prevention measures on the Website, but we cannot guarantee that our services will always be virus-free. You should ensure that your devices used to access Services are protected against viruses and malicious software. You must not use or expose the Website to virus or malicious software contamination.
11. Regulation of our services
a) Our Services are only available to adults over 18 years of age.
b) Our Healthcare Consultations are regulated by the Care Quality Commission in the UK.
c) If you are accessing our Services from outside the UK, you should check whether it is lawful to access our Services in the territory where you are. We provide our Services in compliance with UK law and regulation, therefore cannot take responsibility for any differences between those rules and any different rules applying to healthcare Services anywhere else.
12. Complaints and disputes
a) We are always looking at how we can improve the Products and Services we provide. Please share any feedback you have by calling or emailing us via the details on our contact us page.
b) We provide our Services using reasonable skill and care from appropriately qualified, and experienced, staff and Clinicians. If you think that our Services have not met this standard, please contact us as soon as possible. We will undertake an investigation into your complaint, as well as fix or re-perform, without charge, any Services we agree do not meet this standard.
c) You can click here to view our Complaints Policy. If you have a complaint about our Products or Services, it is important to us that we resolve it as soon as possible. Please tell us about your complaint as soon as you can in writing by emailing us at info@drfertility.co.uk or by writing to us at Dr Fertility Ltd Headquarters, 8 Hayescroft Gardens, Didsbury, Manchester, M20 2AA. If you do email us, it would be helpful if you can provide as much detail as possible for us to start looking into the problem, as well as a contact phone number if you are happy for us to call you back. For example, for product issues we may request the batch and expiry numbers from the product packaging.
d) We will work to resolve the issue for you as soon as possible. If we are not able to do this within 3 working days we will write to you with a summary of the details that have been discussed and the name of the person dealing with your complaint, so that you can be confident that we have understood your complaint and that we are still investigating it.
e) We will also provide an indication of the anticipated timescale for us to complete the investigation. If we are unable to complete the investigation in the advised timescale then we will keep you updated with the progress and revised time scales on a regular basis.
f) Upon completing our investigation, we will write to you setting out the outcome of our investigation into the complaint. We will take any and all actions necessary and reasonable to ensure that problem is not repeated. If we have done something wrong, we will apologise to you.
g) If any disagreement between you and us arises in connection with these terms, we will attempt to resolve it by discussing it with you.
h) If we have not resolved a disagreement about these terms, or a complaint about our Services, you can refer the complaint to the Parliamentary and Health Service Ombudsman (PHSO), Millbank Tower, Millbank, London, SW1P 4QP or visit the 'Making a complaint page at http://www.ombudsman.org.uk/make-a-complaint (to complain online or download a paper form). 13. Waiver
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
14. Variation
Dr Fertility shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services, Products and Website.
15. Invalidity
If any part of these Conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these Conditions will not be affected, all other clauses remaining in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.
16. Your personal information
a) You agree to our use of your personal information as set out in our Privacy Policy.
b) In particular, any personal information relating to you that you provide to us or that is generated as a result of your use of the Healthcare Consultations, Home Testing Services, ordering Products or using the Website may be used to:
i. provide the Services and/or Products purchased;
ii. take payment for the Services and/or Products purchased;
iii. provide relevant information to Clinicians and Pharmacies involved in conducting consultations with you and / or dispensing prescriptions;
iv. detect or prevent fraudulent activity; and
v. comply with requests by any regulatory authority.

17. Prohibitions
a) You must not misuse this Website. You will not: commit or encourage a criminal offence; transmit or distribute a virus, trojan, worm, logic bomb or post any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the Services; corrupt data; cause annoyance to other users; infringe upon the rights of any other person's proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as "spam"; or attempt to affect the performance or functionality of any computer facilities of or accessed through this Website. Breaching this provision would constitute a criminal offence under the Computer Misuse Act 1990. Dr Fertility will report any such breach to the relevant law enforcement authorities and disclose your identity to them.
b) We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any Website linked to it.
18. Intellectual Property, Software and Content
a) Dr Fertility own copyright and other intellectual property rights in our Website, our Services and Content. They are protected by copyright laws and treaties around the world. All such rights are reserved by Dr Fertility and its licensors. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise.
b) You shall not modify, translate, reverse engineer, decompile, disassemble, or create derivative works based on any software or accompanying documentation supplied by Dr Fertility or its licensors.
19. Disclaimer as to ownership of trademarks, images of personalities and third-party copyright
Except where expressly stated to the contrary all persons (including their names and images), third party trademarks and images of third party products, services and/or locations featured on this Website are in no way associated, linked or affiliated with Dr Fertility and you should not rely on the existence of such a connection or affiliation. Any trademarks/names featured on this Website are owned by the respective trademark owners. Where a trademark or brand name is referred to it is used solely to describe or identify the products and services and is in no way an assertion that such products or services are endorsed by or connected to Dr Fertility.
20. Linking to this Website
a) You may link to our Website, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
b) You must not establish a link from any Website that is not owned by you. We reserve the right to withdraw linking permission without notice.
21. Discount codes
a) We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made though this Website.
b) The conditions of use relating to any discount code will be specified at the time of issue. These T&Cs relate to all Dr Fertility promotions, competitions, and discount codes (unless otherwise stated).
i. Only one promotion code can be used per order.
ii. When you add a product bundle to your basket, a discount is automatically applied at checkout. You can only use one type of discount per order, which is why the discount field is not visible if you then try to enter another discount code.
