These Gift Card Terms and Conditions
THESE TERMS APPLY TO PURCHASES OF A GIFT CARD FOR SPENDING WITH ONE OF OUR THIRD PARTY VENDORS OR FOR PURCHASING A MÓR MEMBERSHIP ON THE MÓR PLATFORM. PLEASE NOTE THAT ANY PURCHASE OF A PRODUCT, SERVICE OR EXPERIENCE YOU MAKE FROM ONE OF OUR THIRD PARTY VENDORS USING A GIFT CARD IS SUBJECT TO THE APPLICABLE THIRD PARTY VENDOR'S TERMS AND CONDITIONS WHICH YOU WILL BE REQUIRED TO ACCEPT AT CHECKOUT.- For information on Mór membership please see our Mór Member Terms and Conditions.

- We are Mór, and we are the operator of the Mór Platform – the e-commerce platform at themorcard.com where Mór Members can purchase products, services and experiences from our third party Vendors.
- When we say "we", "our" and "us" in this Privacy Notice, we mean Loytech Limited, which runs the Mór Platform. When we say "you" or "your", we mean you or, where the context otherwise requires, any person who has validly registered to become a Mór Member and for whom a Mór Member Account has been created and remains open.
- When we refer to "Vendor Offers", we mean offers to purchase products, services and/or experiences made available by our third party Vendors via the Mór Platform.

Our contract with you
- Our acceptance of your order for a gift card will take place at the point when you make payment and we confirm receipt of your payment at which point a contract will come into existence between you and us. If we are unable to accept your order, we will inform you of this and will not charge you for the gift card. This might be because of unexpected limits on our resources which we could not reasonably plan for or because we have identified an error in the price or description of the gift card.
- We will assign an order number to your order and tell you what it is when we accept your order. The gift card will also contain a unique redemption code. It will help us if you can tell us the order number or the gift card redemption code whenever you contact us about your order.

Redemption information
- Mór gift cards can only be used either to redeem Vendor Offers on the Mór Platform or to purchase a Mór Membership.
- If you are, or the intended recipient of the gift card is, not a Mór Member a gift card that includes Mór Membership (i.e. “Membership + £100”) must be purchased. A ‘spend only’ gift card (i.e. “£100”) is only suitable for existing Mór Members.
- Where the cost of a Vendor Offer or the selected Mór membership tier is more than the value on a Mór gift card, you will be asked to make up the difference using another payment method.
- Where the cost of a Vendor Offer or the selected Mór membership tier is less than the value on a Mór gift card, the balance will remain on the gift card and will continue to be subject to these Terms. Change will not be given in cash.
- Please protect your card and treat it as cash; we cannot replace lost, stolen or damaged gift cards. Cancelled gift cards will not be able to be used to purchase Vendor Offers or Mór membership.
- Mór gift cards cannot be exchanged for cash.
- Mór gift cards shall be valid for 12 months from the date of purchase or last use.
- If you make a purchase of a Vendor Offer with a Mór gift card that Vendor Offer is subsequently returned, the value of the Vendor Offer will be credited to a gift card; you will not receive a cash refund.
- If a Vendor Offer is excluded from redemption by gift card, this will be clear on the applicable Vendor Offer page on the Mór Platform.
- We reserve the right to refuse to accept a gift card that we deem or suspect to be tampered with, duplicated or otherwise affected by fraudulent activity.

Our rights to make changes
- We may change the gift cards to reflect changes in relevant laws and regulatory requirements or to implement minor technical adjustments and improvements, for example to address a security threat. These changes will not affect your use of a gift card.
- In addition, we may make changes to these Terms however the terms in place at the time of your purchase of a gift card will continue to apply to that gift card.

Providing the gift cards
- When you purchase a gift card, we will make this available to you by email.
- You will own the gift card you purchase once we have received payment in full however you may gift the gift card to another person who can then spend the gift card on the Mór Platform. Before they can make a purchase of a Vendor Offer or a Mór membership using their Mór gift card they will require to register as a Mór Member. - If you are, or the intended recipient of the gift card is, not a Mór Member a gift card that includes Mór Membership (i.e. “Membership + £100”) must be purchased. A ‘spend only’ gift card (i.e. “£100”) is only suitable for existing Mór Members.

Your rights to end the contract
- Your rights when you end the contract will depend on whether there is anything wrong with the gift card, how we are performing, and when you decide to end the contract.
- If you are ending a contract for a reason set out below the contract will end immediately and we will refund you in full for any gift cards which have not been provided. The reasons are:
- we have told you about an error in the price or description of the gift card you have ordered and you do not wish to proceed;
- there is a risk that supply of the gift cards may be significantly delayed because of events outside our control;
- we have suspended supply of the gift cards for technical reasons, or notify you we are going to suspend them for technical reasons; or
- you have a legal right to end the contract because of something we have done wrong.
- Purchases of gift cards have a 14 day refund period, from the date we email you with your order, after which they are non-refundable. You do not have a right to a refund if you use your gift card to make a purchase within this 14 day period.
- If you are entitled to a refund under these Terms, we will refund you the price you paid for the gift card, by the method you used for payment.

Price and payment
- Gift cards may be purchased from the Mór Platform.
- The price of the gift card (which includes VAT) will be the price indicated on the Mór Platform when you placed your order. We take all reasonable care to ensure that the price of the gift card advised to you is correct. It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the gift card's correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the gift card's correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and cancel any gift card provided to you.
- We accept payment with credit card, debit card, and mobile payments (for example Apple Pay). You must pay for the gift card before we make it available for download.
- If you think an invoice is wrong, please contact us promptly to let us know.

Our responsibility for loss or damage suffered by you
- The ability to purchase gift cards on the Mór Platform is only made available and intended for domestic and personal use, and as such we do not accept (and under no circumstances) shall be liable for any losses that were not foreseeable to both parties when the contract was formed, or for business losses or losses to non-consumers.
- Where we are found to be liable to you, our total aggregate liability (regardless of how many claims are brought) shall be limited to the total value of the gift card relating to the claim.
- Notwithstanding any other provision of these Terms, we do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.

The role of the third party Vendor
- When you purchase a Vendor Offer from a third party Vendor, that third party Vendor is solely responsible for:
- the fulfilment of the purchase of the Vendor Offer;
- any defects, deficiencies, faults or other issues relating to Vendor Offers (or for products, services or experiences provided in relation to such Vendor Offer);
- any death, personal injury or damage to property arising out of, or in connection with a Vendor Offer (or products, services or experiences provided in relation to such Vendor Offer); and
- any breach of the agreement between you and the third party Vendor or any other applicable laws relating to the Vendor Offer.
- If there are any disputes, claims, complaints or issues relating to a Vendor Offer, then your rights and remedies are against the relevant third party Vendor and not Mór.
- Any cancellations or requests for a refund in respect of any Vendor Offer purchased with your gift card should also be directed to the applicable third party Vendor and shall be dealt with in accordance with the relevant Vendor terms and conditions applicable to your purchase.

Other important terms
- We may transfer our contract with you to anyone who acquires our business. If this were to happen, we would let you know. The contract is personal to you so you cannot transfer it to anyone else unless we agree in writing and no other person shall have any rights to enforce any of its terms.
- Any failure by us to enforce any of our rights or obligations set out within these Terms will not constitute a waiver of our rights to subsequently enforce such provision or any other provision of these Terms.
- If any part of these Terms and conditions is determined to be invalid or unenforceable then such term shall be deemed to be superseded by a valid and enforceable term that most closely matches the intent of the original term and the remainder of these Terms shall continue to apply.

The law that applies to this contract
- The law that applies to this contract will be the law governing whichever part of the UK you live in – so if you live in England or Wales, the law of England and Wales applies; if you live in Scotland Scots law applies and if you live in Northern Ireland, the law of Northern Ireland will apply. If you live in the Republic of Ireland, then Irish law will apply.
