Mór Member Terms and Conditions

- You should read these Terms carefully as they create a contract between us which will be binding on you if you become a Mór Member.
- These Terms explain how you become a Mór Member and the different tiers of membership we offer please see Sections 4, 5 and 6.
- For information on how you can make purchases on our Mór Platform and the role of our third party Vendors please see Section 9.
- As operator of the Mór Platform, we are not responsible (and don't have any liability) for any Vendor Offer you buy from our third party Vendors. Any claim lies solely against the Vendor from whom you buy a Vendor Offer. Please see Section 11.
- As a Mór Member, we will send you emails about the benefits of Mór membership and in some circumstances also send you marketing emails. Please see Section 13.
- We may close, suspend, or downgrade your Mór Member Account in certain circumstances including if you or your sponsor do not pay the Mór Member Fee, or if your Mór Member Account is dormant. See Sections 18, 19 and 20.
- We reserve the right to correct errors and mistakes. Please see Section 15.
- We have the right to change our Terms. If you will be disadvantaged by any change, we will give you at least 30 days' notice. See Section 17.

Who are we and what is Mór?
- We are Mór, and we are the operator of the Mór Platform – the e-commerce platform at themorcard.com where Mór Members can purchase products, services and experiences from our third party Vendors.
- Mór is a trading name of Loytech Limited, a private limited company incorporated in England and Wales under company number 13134112 and registered office at 71 Queen Victoria Street, London, United Kingdom, EC4V 4BE.
- When we say "we", "our" and "us" in these Terms, we mean Loytech Limited, which runs the Mór Platform.
- When we say "you" or "your", we mean you or, where the context otherwise requires, any person who has validly registered to become a Mór Member under these Terms (see Who is eligible and how can I become a Mór Member? below) and for whom a Mór Member Account has been created and remains open.
- When we refer to "Vendor Offers", we mean offers to purchase products, services and/or experiences made available by our third party Vendors via the Mór Platform.

- All formal communications and notices you send to us should be sent by email. We will send our notices to you at the email address you have given us when you become a Mór Member or any email address you notify to us afterwards by updating your Mór Member Account details.

- If you have any complaints or issues about Mór, your Mór Member Account or any communications from Mór, please contact us in any of the ways set out in this section.
- If you have any complaints or issues regarding a third party Vendor, any Vendor Offer you have purchased (or any goods, services and experience to which the Vendor Offer relates) or any communications from a third party Vendor, please contact the relevant Vendor (see What is your role and who is responsible for fulfilling my order?) in the first instance.

How does the Mór Platform work and what are the benefits?
- We operate the Mór Platform – which allows you to access a range of Vendor Offers from our third party Vendors.
- Our third party Vendors represent a variety of sectors: Accessories, Adventure, Beauty, Culture, Drink, Food, Fashion, Gifting, Home, Hotels, Learning, Outdoors, Spa, and Wellness.
- Our third party Vendors include well known brands that are category leaders as well as independent challenger brands.
- We act as a sales agent for our third party Vendors in relation to the sale of Vendor Offers to you via the Mór Platform, in return for which we are paid a sales fee by the relevant third party Vendor.
- Please note we make no guarantees about the availability of any Vendor Offer you see on the Mór Platform, which are available on a first come first served basis and these are subject to change at any time.

Who is eligible and how can I become a Mór Member?
- You can become a Mór Member by either signing up and purchasing membership yourself, as an individual, or if you receive it from a company we have entered in to a Corporate Membership agreement with – this could, for example, be your employer.
- To become a Mór Member you will need to register with us. We require your full name and email address to register and you will be asked to create a secure password for your Mór Member Account. We will then send you a registration email which you will be required to verify to complete your registration as a Mór Member.
- Please note you must be at least 16 to become a Mór Member however certain experiences may only be available to those who are 18+. We may need to ask you for your date of birth and some of our third party Vendors may need you to provide photo ID – for example if the experience you purchase is related to alcohol.
- By registering as a Mór Member you confirm that you agree to and accept these Terms.
- By agreeing to these Terms you also confirm that you agree to and accept our Privacy Policy and Website Terms and Conditions.
- We will communicate with you from time to time as required for the proper operation and administration of your Mór Member Account. As part of the registration process to become a Mór Member, you will be given the opportunity to opt in or out of our marketing emails (see Will you send me emails?).
- Over the course of your first month as a Mór Member we will send you a detailed "How To" guide to Mór, and other useful information on how Mór works so you can get the most out of your membership.

How does Membership work?
- You may choose to register as a Mór Member by paying the Mór Membership Fee (see Who is eligible and how can I become a Mór Member?). For up-to-date information on the cost of becoming a Mór Member, relevant subscription terms and the benefits please see themorcard.com/membership.
- Once you have registered as a Mór Member you will be able to browse our Mór Member-only content on the Mór Platform. When logged in to your account you will also be able to view our Top Secret Vendor Offers. You may also be sent a physical membership card.
- Except as otherwise provided below, your Mór Member Account will automatically renew for a further year at the end of your current term however we will provide advance notice beforehand.
- Please note that if your Mór Membership Fee is paid by a third party sponsor, your membership will not automatically renew (see How does Corporate Membership work?).

How does Corporate Membership work?
- From time to time, we may enter into agreements with third parties who wishes to make the benefits of a Mór Member Account available to their valued customers, employees, members, partners, representatives, or other persons on a sponsored basis.
- Where a sponsoring third party pays for you to become a Mór Member – no further payment is required from you to register as a Mór Member. In such circumstances, you will be issued with a promotional code by your sponsor which can be applied during your registration process to discount the Mór Membership Fee payable by you for the relevant subscription period.
- Once you have registered as a Mór Member you will be able to browse our Mór Member-only content on the Mór Platform. When logged in to your account you will also be able to view our Top Secret Vendor Offers. You may also be sent a physical membership card.
- In the event your third party sponsor does not continue to pay any Mór Membership Fees due on renewal your membership will be cancelled or you may pay the Mór Membership Fee to remain a Mór Member.

What should I do if I don't want to be a Mór Member anymore?

- You can ask for your Mór Member Account to be deleted at any time by contacting us (see How do I contact you?).
- Except as set out below, if you submit a request to close your Mór Member Account within 14 days of your Account being opened, you shall be entitled to a full refund of your paid Mór Membership Fee if you have not made a purchase of a Vendor Offer.
- If you submit a request to close your Mór Member Account either
- (a) more than 14 days after opening your Account or
- (b) within 14 days of opening your Account but you have already purchased a Vendor Offer
you will not be entitled to any refund of your Mór Membership Fee.
- No refund will be payable upon the closure of a Mór Member Account where the Mór Membership Fee has been paid by a third party sponsor.
- Please note that Mór retains the right to close your Mór Member Account in the event you do not comply with these Terms and/or your conduct is considered to be inconsistent with these Terms and our other policies, including our Website Terms and Conditions. If we do this, you will not be entitled to a refund of any paid but unused Mór Membership Fee (if applicable).

How do I purchase a Vendor Offer?

- All information about how you can purchase a Vendor Offer will be displayed on the relevant Vendor Offer page on the Mór Platform including how your purchase will be fulfilled and any special conditions that apply.
- Please note any purchase of a Mór gift card will also be subject to the Mór Gift Card Terms and Conditions.

Can third party Vendors providing Vendor Offers be changed?
- Yes. The Mór Platform is all about bringing you the best and most up to date brands so third party Vendors and the availability of Vendor Offers will change frequently. However, if you have purchased a Vendor Offer with a specific Vendor this will still be valid for the time period (if any) specified in the Vendor terms that apply to that Vendor Offer when you purchase it even if the Vendor concerned no longer features on the Mór Platform.
- Yes. The Mór Platform is all about bringing you the best and most up to date brands so third party Vendors and the availability of Vendor Offers will change frequently. However, if you have purchased a Vendor Offer with a specific Vendor this will still be valid for the time period (if any) specified in the Vendor terms that apply to that Vendor Offer when you purchase it even if the Vendor concerned no longer features on the Mór Platform.

What is your role and who is responsible for fulfilling my order?
- Mór operates the Mór Platform on which you can make purchases from our third party Vendors. Mór is a sales agent on behalf of the third party Vendors and is not the retailer or vendor of any Vendor Offers. Payment of the purchase price to Mór for a Vendor Offer shall be deemed for all purposes to be payment of the purchase price to the relevant third party Vendor.
- The agreement to purchase a Vendor Offer is between you and the relevant third party Vendor. The terms and conditions that apply to the purchase of a Vendor Offer are those of the relevant third party Vendor, which you will need to accept at check-out.
- Mór is not in partnership with any of the third party Vendors who may provide Vendor Offers.
- The third party Vendor that you purchase a Vendor Offer from is responsible for:
- the fulfilment of your Vendor Offer;
- any defects, deficiencies, faults or other issues relating to a Vendor Offer (or any goods, services and/or experiences provided in relation to such Vendor Offer);
- any death, personal injury or damage to property arising out of, or in connection with a Vendor Offer (or any goods, services and/or experiences provided in relation to such Vendor Offer); or
- any breach of its agreement with you or any other applicable laws relating to the Vendor Offer.
- If there are any disputes, claims, complaints or issues relating to a Vendor Offer purchased on the Mór Platform, then your rights and remedies are against the relevant third party Vendor and not Mór. Any cancellations or requests for a refund in respect of Vendor Offers purchased on the Mór Platform should also be directed to the applicable third party Vendor and shall be dealt with in accordance with the Vendor terms and conditions applicable to such Vendor Offer.
- Mór membership is only made available and intended for domestic and personal use, and as such Mór does not accept (and under no circumstances) shall be liable for any losses that were not foreseeable to both parties when the contract was formed, business losses or losses to non-consumers.
- Where we are found to be liable to you, our total aggregate liability (regardless of how many claims are brought) shall be limited to the greater of: i) the total value of all sales fees retained by Mór in relation to Vendor Offers purchased by you in the previous 12 month period; and ii) the total value of any Mór Membership Fee paid by you in the previous 12 month period.
- Notwithstanding any other provision of these Terms, we do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.

How will you use my data?
- We will use the information you give us in relation to your Mór Member Account and this and any other information you give us at any time shall be processed in accordance with our Privacy Policy.
- Generally, we use your personal data to operate and administer our Mór Website, your Mór Member Account, and to share your details with our third party Vendors when you make a purchase. You acknowledge and agree that data supplied to a third party Vendor may be further used and retained by the Vendor where permitted in accordance with the relevant third party Vendor's terms and conditions.

Will you send me emails?
- Yes – as a Mór Member, we will send you Mór Member communications consisting of administrative, operational, marketing and promotional content. These will be sent by email.
- You may opt-out of receiving marketing emails containing details such as new third party Vendors and Vendor Offers at any time by clicking ‘unsubscribe’ in the footer of any of our emails.
- However, please note that if you opt-out of receiving marketing emails from us, you will still receive service emails relating to your Mór Member Account and any purchases of Vendor Offers you make.

What are my responsibilities?
- As a Mór Member there are certain things we require of you:
- You must provide us with accurate and current information about yourself when you register to become a Mór Member – including correct name, email address, date of birth and other requested details. Please keep these updated and inform us if anything changes.
- You must provide us promptly with any information and help we may reasonably ask for if we (or anyone else) have any queries about your Mór Member Account or its transactional activities. We may pass any information you provide to third parties if they have a legitimate reason for asking for it.
- We ask that you keep your password and other identifying information related to you Mór Member Account secure. If we ask you to for security reasons, you must change password or other information which facilitates access to your Mór Member Account. If you know or suspect that anyone other than you knows your Mór Member Account password, you must promptly notify us (see How do I contact you?).
- You must agree to our Website Terms and Conditions when accessing and using the Mór Platform.
- The Mór Platform may only be used by you acting in a personal capacity for domestic and private use. You must not use the platform (or any content from the platform) for any commercial or business purposes without obtaining a licence to do so from us.
- You must not use someone else's personal information, or a payment method which you are not entitled to use.
- We will never ask you for your password via email, telephone, or any other means other than through the Mór

Errors and mistakes
- In providing the benefits of the Mór Platform, including providing access to a range of Vendor Offers, we agree to take reasonable care and act in good faith. Very occasionally, however, mistakes or errors may occur. These may include system errors affecting the Mór Platform technology or errors or mistakes in the terms of Vendor Offers from our third party Vendors.
- Where a mistake or error occurs, we will inform affected Mór Members as soon as possible and will seek to rectify the error or mistake to put you, us and relevant third party Vendors in the position each party would have been in had the error or mistake not occurred.

Can you take away my membership?
- Yes, we can. We have the right to suspend or cancel your Mór Member Account, or parts of it, if in our reasonable view you appear to be in breach of any of these Terms in any significant way or in the event of any fraudulent, abusive or other activity or misuse we determine to be unfair. If your Mór Member Account is cancelled this will not affect any prior purchases already made on our Mór Platform.
- Yes, we can. We have the right to suspend or cancel your Mór Member Account, or parts of it, if in our reasonable view you appear to be in breach of any of these Terms in any significant way or in the event of any fraudulent, abusive or other activity or misuse we determine to be unfair. If your Mór Member Account is cancelled this will not affect any prior purchases already made on our Mór Platform.

Can you change these terms?
- We can change these Terms at any time and if we do so we will tell you by email. We will also post any new terms on our Mór Platform.
- If our third party Vendors offer any new Vendor Offers we may introduce additional terms or change these Terms so that they are appropriate to cover the new offering.
- If any change to these Terms is materially detrimental to the terms of your Mór membership, we will tell you about it at least 30 days prior to the change taking effect. If you do not agree with any change, you can cancel your Mór Member Account by contacting us (see What should I do if I don’t want to be a member anymore?).

What happens if I do not pay my Mór Membership fee?
- If at any point you fail to make payment of your Mór Membership Fee (for example you don’t pay your subscription fee or you don’t renew your chosen subscription) your membership will be cancelled.
- This change will take place upon expiry of the term covered by your previous Mór Membership Fee.

What happens if your third party sponsor does not continue to pay any Mór Membership fees due on renewal of your membership?

- If a third party sponsor does not pay your Mór Membership Fees or renew your Mór Member Account, your Mór Member Account will be terminated at the expiry of your then current subscription term in respect of which a Mór Membership Fee has been paid.
At that point, you will be offered the opportunity to continue as a Mór Member by paying the applicable Mór Membership Fee.

Can Mór be suspended?
- Yes, we may suspend access to the Mór Platform at any time where we have legal, security, technical or commercial reasons to do so.
- Where we can, we will provide you with reasonable notice in advance of any suspension of the Mór Platform and will explain the reasons for the suspension and how long it may last. In some cases, however, we might need to take urgent action for security reasons or because of technical difficulties which would otherwise adversely affect Mór and/or the Mór Platform.
- There may also be times when our systems become unavailable as a result of technical difficulties, planned maintenance or problems with the internet. We will try to overcome these difficulties where they are within our control but we cannot guarantee functionality and availability at all times.

Anything else?
- Yes - these Terms form a contract between you and us so we need to tell you about some other terms that apply to our relationship with you.
- We may transfer our contract with you to anyone who acquires our business. If this were to happen, we would let you know. The contract and your Mór membership is personal to you so you cannot transfer it to anyone else.
- The legal rights to the Mór Platform, all content and our trade marks and branding belong to us. The trade marks and branding of third party Vendors belongs to such third party Vendors.
- Any failure by us to enforce any of our rights or obligations set out within these Terms will not constitute a waiver of our rights to subsequently enforce such provision or any other provision of these terms.
- If any part of these Terms is determined to be invalid or unenforceable then such term shall be deemed to be superseded by a valid and enforceable term that most closely matches the intent of the original term and the remainder of these Terms shall continue to apply.
- The law that applies to this contract will be the law governing whichever part of the UK you live in – so if you live in England or Wales, the law of England and Wales applies; if you live in Scotland Scots law applies and if you live in Northern Ireland, the law of Northern Ireland will apply. If you live in the Republic of Ireland, then Irish law will apply.
